The Alliance for a Healthier Generation ("Alliance") is a joint initiative of the William J. Clinton Foundation ("Foundation") and the American Heart Association (AHA"), both of which are not-for-profit charitable organizations. The Foundation's Privacy Policy describes how the Foundation collects and uses personal information, and can be found at http://www.clintonfoundation.org/privacy/. This Privacy Statement and Terms of Use provides additional information on the Alliance's practices in collecting and using personal information the Alliance collects from children under 13 years of age. It also applies to information submitted by users through our Web Site and information submitted by parents about themselves and their kids for participation on our Web Site.

 

 

Who operates this Web Site?

 

The AHA and the Foundation operate empowerme2be.org as the Web Site for the national campaign of the Alliance’s Kids’ Movement (the "Web Site"). On our Web Site, boys and girls can download and submit content (Submitted Material) related to healthy living, play educational games, learn about how to keep active and eat right, and find tools to help motivate others to do the same.

 

Parents can also play an important role by instilling healthy habits and a lifelong love of healthy living. As part of this campaign, many of the activities on our Web Site are designed to get the whole family involved in being physically active together.

 

What are the risks associated with physical activity?

 

You acknowledge that by using or registering for the empowerME Movement on this Web Site you are enrolling in one or more of the Alliance for a Healthier Generation programs (Alliance Programs) voluntarily and for your own personal reasons. The Alliance Programs might advocate or involve physical activity which may involve physical risks. You hereby expressly assume all risk arising out of your participation. It is your responsibility to consult with a physician to determine whether participation in the Alliance Programs is right for you. It is also your responsibility to use equipment, clothing, and technique appropriate to the activities related to the Alliance Programs. You are solely responsible for your own safety. You agree to not sue, and to release, indemnify and hold harmless, the Alliance, its affiliates, officers, directors, volunteers and employees, and all sponsors of the Alliance Programs sponsors and the agents of such sponsors, from any and all liability, claims, demands, and causes of action whatsoever, arising out of your participation in the Alliance Programs, whether arising from the negligence of any of the above parties or from any other cause. The foregoing release, indemnification, and hold harmless shall be as broad and inclusive as is permitted by the state in which you live. You acknowledge and agree that the Alliance may discontinue the Alliance Programs without notice to you and that you shall have no continuing rights in the Alliance Programs upon such termination. If any portion of this agreement is held invalid, the balance shall continue in full force and effect.

 


What information does the Alliance collect and use?

 

Personally Identifiable Information. We do not ask for any personally identifiable information beyond what is reasonably necessary for a child to register in the empowerME Movement and participate in the activities offered on our Web Site. Specifically, the Alliance collects the first and last name of each child using this Web Site, his or her age, email address, city, state, zip code and other information to help track the child's progress in attaining health-related goals. By registering, children will also receive email newsletters and updates.  These emails contain information about new features, promotions and activities on the Web Site. Signing up for the email updates is voluntary, and a child or parent/guardian can stop receiving the updates at any time. Every email we send includes information on unsubscribing from our mailing list. If you or your child no longer wishes to receive an email message, just use this feature to unsubscribe by replying to the “opt out” option located at the bottom of the email, indicating you no longer wish to receive updates.

 

Children can surf portions of our Web Site and view limited content without any personally identifiable information being collected. We do not collect personally identifiable information from children unless they register and provide us with consent from a parent or guardian. In order to register for our Web Site and participate in most of the available activities, however, children must complete the registration form.

 

Submitted Material. Children may also upload content to our Web Site (Submitted Material) which will only be used by the Alliance upon a parent/guardian’s completion and return of the Alliance’s Consent and Release Form. All content is subject to review and modification by Alliance staff prior to publication on the Web Site.

 

How does the Alliance collect this information?

 

Personally Identifiable Information. During registration, children are asked to provide their contact information, including their first name and last name, e-mail address, city/state and zip code. The Alliance does not use cookies, GIFs, Web beacons or similar technology to collect personal information, but may use such automated devices to track general traffic and internet activity on an anonymous basis.

 

Submitted Material. During the user-generated content submission process, registered users under 18 years of age are requested to provide a parent’s email address. An email is sent to the parent with a link to download the Alliance’s Consent and Release Form to be completed, signed and returned to the Alliance as a scanned document to empowerme@healthiergeneration.org or to a fax number provided in the email. The Alliance can then review, edit (if necessary) and post the story, photo, or video (but is not required to do so if the Content is not appropriate for our needs). If a user is 18 years old or over, the link to download the form will be delivered to the individual’s email address in the same fashion. Once they sign and return the form, the Alliance can then review, edit (if necessary) and post the story, photo or video.

 

How will the Alliance use this information?

 

Personally Identifiable Information. The Alliance uses the personal information provided by the children for record keeping and to track their progress in Alliance activities. The Alliance may use the email addresses to email children about their participation in Alliance programs and activities and that contain educational materials on exercise and nutrition. The personally identifiable information we collect will only be used as specified above, and will not be available for others to view on our Web Site(s).

 

Does the Alliance share this information with any third parties?

 

Neither the AHA nor the Foundation will share personal information received from children with third parties. The AHA and the Foundation may share such information with each other.

 

What are the Alliance’s limitations on user’s Submitted Materials?

Please carefully choose the information you post on or through the Site. You may not post on or supply the Site any form of prohibited Content, as outlined below. Despite this prohibition—information, materials, products or services provided by other users may, in whole or in part, be unauthorized, impermissible or otherwise violate this Agreement, and the Alliance assumes no responsibility or liability for this material. If you become aware of misuse of the Site by any person, please email empowerme@healthiergeneration.org to contact The Alliance for a Healthier Generation, and share your concern with us.

 

You agree to post only messages, information or other content that are proper, lawful, and related to the Alliance’s health mission. In addition, but without limitation, you may not post content that: 

  • - Defames, threatens, or abuses others;
  • - Is racially or ethnically offensive;
  • - Is obscene, pornographic, vulgar, or harmful to children;
  • - Infringes another's rights to intellectual property, publicity, or privacy;
  • - Contains advertisements, promotions, or commercial solicitations;
  • - Contains information intended to assist in the placement of a bet or wager; or
  • - Contains viruses, corrupted files, or any other similar software or programs that may damage the
  •   operation of another's computer.
  •  

In addition, the Alliance may edit, format and revise submitted content for length and consistency, and to assure that any health or science information, whether explicitly stated or implied in the submitted content is consistent with the health mission of the Alliance.

 

You acknowledge that all interactive areas are public and not private communications; therefore, any information or content you post to an interactive area may be read by others. The Alliance urges you not to post or submit any personally identifiable information, whether yours or that of any other person, and it will remove or delete any personally identifiable information of which it becomes aware.

 

The Alliance reserves the right, in its sole discretion, to reject, refuse to post, or remove any content you post or submit to its Web Site(s), or to deny, restrict, suspend, or terminate your access to all or any part of the Site at any time, for any or no reason, with or without prior notice or explanation, and without liability. The Alliance expressly reserves the right to remove and/or deny, restrict, suspend, or terminate your access to all or any part of the Site if the Alliance, in its sole discretion, determines that you have violated this Agreement or pose a threat to the Alliance and/or its users. The Alliance hopes that you will find the information provided on the Site informative and useful. The Alliance is pleased to provide the information on the Site conditioned upon your acceptance, without modification, of the terms, conditions and notices contained in this Statement.

 

Proprietary Rights Regarding Member Content. The Alliance does not claim any ownership rights in the Content that you post on or through the Site ("Member Content"), except for those rights provided to the Alliance through its receipt of a signed Consent and Release Form. After posting your Content to the Site, you continue to retain any such rights that you may have in your Member Content, subject to the limited license herein. By displaying or publishing any Content on or through the Site, you hereby grant to the Alliance a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content, including without limitation distributing part or all of the Content in any media formats and through any media channels. You also hereby grant each user of the Site a non-exclusive license to access your Content through the Site, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Site and under this Statement. The license you grant to the Alliance is non-exclusive, perpetual, fully-paid and royalty-free, and worldwide.

Use of Images and Music. By uploading Submitted Materials to the Web Site, you represent and warrant that you have the right to upload this content and that you have obtained any necessary consents with respect to images or music appearing in your submission.

 

No Endorsement. The Alliance for a Healthier Generation does not sponsor, endorse or recommend any of the user-generated health narrative (Submitted Material) on this Web Site. The views, expressions and opinions are those of youth members of the Site, not the Alliance.
